This is the story of the maroons’ ethnogenesis in Florida, their removal to the West, their role in the Texas Indian Wars, and the fate of their long quest for liberty and self-determination along both sides of the Rio Grande. Their tale is rich, colorful, and epic, stretching from the swamps of the Southeast to the desert Southwest. This thesis examines the involvement, leadership, and impact of the Black Seminoles during the Second Seminole War. In Florida, free Blacks, runaway slaves, and Blacks owned by Seminoles collectively became known as Black Seminoles. Black Seminoles either lived in separate communities near Seminole Indians, or joined them by cohabitating or intermarriage. Throughout this cohabitation, Blacks became an integral part of Seminole life by taking positions as advisers, counselors, and trusted interpreters to the English (who were rapidly advancing plantation society into territorial Florida).

By the advent of the Second Seminole War, Black Seminoles, unlike their Seminole Indian counterparts were not given the opportunity to emigrate westward under the United States government’s Indian Removal Policy. The United States government’s objective became to return as many Black Seminoles, if not all, to slavery. Therefore, it became the Black Seminole’s objective to resist enslavement or re-enslavement (for many) on American plantations.

The Introduction explains the objective and focus of this study. Moreover, it explains the need and importance of this study while examining the historiography of the Second Seminole War in relation to the Black Seminoles. The origins and cultural aspects of the Black Seminoles is the topic of chapter one. By examining the origins and cultural aspects of the Black Seminoles, this study establishes the autonomy of the Black Seminoles from their Indian counterparts. Chapter two focuses on the relationship and alliance between Seminole Blacks and Indians. Research concerning Black Seminole involvement throughout the war allows chapter three to reconstruct the Second Seminole War from the Black Seminole perspective. A biographical approach is utilized in chapter four in order to understand the Black Seminole leadership. This chapter examines the lives of the three most prominent Black Seminole leaders during the war. The overall impact of the Black Seminole involvement in the war is the focus of chapter five. Chapter six summarizes this study and provides the historiography of the Second Seminole War with a perspective that has remained relatively obscure.

It is clear that from the onset of the war, the United States government, military, and state militias grossly underestimated both the determination and the willingness of the Black Seminole to resist at all cost. Throughout the war, both United States’ military and political strategies were constructed and reconstructed to compensate for both the intensity with which the Black Seminoles fought as well as their political savvy during negotiations. This study examines the impact of the Black Seminoles on the Second Seminole War within the context of marronage and subsequently interprets the Second Seminole War itself as a form of slave rebellion.

The study begins with Philip Cuney. He had much in common with other paternalistic slaveholders of the South. He believed in the institution of slavery and had grown accustomed to the lifestyle that the peculiar institution afforded him. By Texas standards, his large tracts of land and his large number of slaves made him a wealthy man. He became a respected and prominent leader in Austin County. Cuney also went into Texas politics and gained some success both before and after Texas became a state. Cuney, like many Southern planters, used his powerful position as a slaveholder to begin a sexual relationship with one of his female slaves. His relationship with his slave Adeline Stuart produced eight slave children. Along with his white wife and children, Cuney in effect had two families, one white and one black.

…[Norris Wright] Cuney, as an urban black, seemed far removed from the mass of nineteenth-century black Texans who lived in rural areas pursuing agricultural endeavors in impoverished conditions. In many ways, Cuney represented a new urban black middle class. As a mulatto he represented a minority within a minority. Cuney strongly identified himself as a “Negro.” Many men of mixed heritage within the first generation of black leadership following the Civil War became a black elite both culturally and politically. As the son of an upper-class white man and a mulatto slave, Cuney represented an even more select group of blacks who received an education and freedom from their white fathers. According to Joel Williamson, “It was almost as if mixing of this special sort in late slavery had produced a new breed, preset to move into the vanguard of their people when freedom came.”

White southerners, steeped in the ideology of slavery and black inferiority, and feelings of guilt over miscegenation, refused to see a difference between mulattoes and darker skinned blacks. Most Southern states codified this view into law. Some Antebellum mulattoes, especially house servants and others in close contact with their white fathers, often viewed themselves as distinct from other blacks; but following the Civil War, their interests fused with those of the black community. When freedmen entered the political arena they shared common enemies and objectives that made this fusion permanent. Dark-skinned blacks viewed this relationship as positive. According to Williamson, “they needed verbal and mathematical literacy, economic, political, and social education, and people to teach their teachers.” The mulatto elite along with Northern missionaries provided that help.”…

This article proposes that a historical analysis of court cases and state statutes can be used to illustrate how racist ideologies were transformed into practice and used to legalize racism. To exemplify this argument, marriage prohibition laws in the United States Southwest from 1837 to 1970 are examined.  This analysis demonstrates that African Americans and Anglo Americans were not the only groups affected by anti-miscegenation legislation.  Mexican Americans, Asian Americans, and Native Americans were also profoundly affected and their respective histories contribute to a more indepth understanding of the policies and practices used by state governments and the courts to discriminate against people of color.  This article also reveals that most legal cases reaching state supreme courts in the Southwest involved Mexican Americans because their mixed racial heritage placed them in a legally ambiguous position.

…Afromestizos and the First Anti-Miscegenation Law in the American Southwest

The history of anti-miscegenation law in the American Southwest began after Texas obtained independence from Mexico in 1836. One year later, on 5 June 1837, the newly formed Republic became the first nation in the Southwest to prohibit people of different races from marrying freely (Marital Rights, art. 4670, 2466, in Paschal, 1878: 783). People of European blood and their descendants were prohibited from marrying Africans and their descendants. A racially mixed person could marry a White person if they had no African ancestors in the last three generations. If the law was broken, the White person was sentenced to two to five years in prison. Texan congressmen justified imprisonment by the seriousness of ‘the offense against public morals, decency, and chastity’ (Tex. Penal Code 386, in Paschal, 1878: 429).

Texas’s anti-miscegenation codes were part of the Republic’s larger body of racially discriminatory laws passed after independence. In 1836, Mexico’s liberal racial legislation was rescinded. Citizenship was no longer extended to all people and Mexico’s Emancipation Proclamation of 1829 was nullified. Only Anglo Americans and Mexicans who were not of African heritage were given citizenship (Cx. of the Repu. of Tex. 1836, art. 6, s. 6, in Laws of Tex., vol. 2, p. 1079). Slavery was also reinstated and freed Blacks who had been emancipated under Mexican law were returned to bondage…

His powerful new book examines how three American families became white

Before Daniel J. Sharfstein’s senior year at Harvard, he spent the summer of 1993 in South Africa as a volunteer for a voter education project. There, one of his fellow workers told him she had been categorized as “colored,” or mixed-race, because a constable doing the classification appreciated her father’s service as a police officer.

“As a result of that one simple act, she had led a very different life from her colleagues,” recalls Sharfstein, now associate professor of law at Vanderbilt University in Nashville, Tenn. “That was a revelation to me, that something that could seem as natural and inevitable as race could bend because of a personal relationship or community ties or even just individual whim.”

He returned to the United States wondering whether the same kind of thing had happened here.

Sharfstein’s South African experience, followed by a stint as a journalist, Yale Law School and years of archival research and interviews, led to The Invisible Line: Three American Families and the Secret Journey From Black to White. The book interweaves the story of three families with African ancestry—the Gibsons, the Spencers and the Walls—who, over time and in different ways, became identified as white. The color line in America, Sharfstein learned, has been surprisingly permeable. The AARP Bulletin talked to Sharfstein by phone.

Q. Throughout American history, how important was physical appearance in defining whiteness?

A. To a certain degree it was important. We have to remember that, for a long time, the United States was a rural society and almost everybody worked outside. There was a really broad range of complexions that could be considered white…

…Q. What was the legal standard for defining whiteness in the 19th century?

A. There really was no standard. Virginia for more than a century had a one-quarter rule. If you had one African American grandparent, that made someone legally black. Other states, like North Carolina, had a one-eighth rule, while South Carolina didn’t have any specific fraction. One South Carolina court held in the 1830s that “a man of worth, honesty, industry and respectability should have the rank of a white man, while a vagabond of the same degree of blood should be confined to the inferior caste.”…

…Q. In slavery’s absence, you write, “preserving white privilege seemed to require new, less flexible rules about race and constant aggressive action to enforce them.” Why?

A. What really mattered in the South, in the antebellum period, was not who was black and who was white, but who was slave and who was free. The prospect of freedom for African Americans was a motivating force getting people to think about what racial categories themselves meant. In the last days of slavery, because slavery as an institution was under such attack, white Southerners were countering with race-based justifications, and that survived the demise of slavery. After the Civil War, as black freedom was taking root, right alongside it were modern forms of racism that persist to this day.

Q. You suggest that rigid rules about race only increased the number of people transitioning from black to white. Why was that?

A. When rules became more rigid, they were almost always accompanied by rules that subjected African Americans to higher taxes, made it harder for them to own land and increased fear that free African Americans would be returned to slavery. The harder these laws made it to live and to provide for their children, the greater the incentives were to make the move from black to white. Because these lines were being drawn in a way that essentially separated people who looked white from [other] people who looked white, it was impossible to make the line between black and white impregnable…

For much of their history, Americans dealt with racial differences by drawing a strict line between white people and black people. But Daniel J. Sharfstein, an associate professor of law at Vanderbilt University, notes that even while racial categories were rigidly defined, they were also flexibly understood—and the color line was more porous than it might seem. His new book, The Invisible Line: Three American Families and the Secret Journey from Black to White, traces the experience of three families—the Gibsons, the Spencers and the Walls—beginning in the 17th century. Smithsonian magazine’s T.A. Frail spoke with Sharfstein about his new book:

People might assume that those who crossed the line from black to white had to cover their tracks pretty thoroughly, which would certainly complicate any research into their backgrounds. But does that assumption hold?

That’s the typical account of passing for white—that it involved wholesale masquerade. But what I found was, plenty of people became recognized as white in areas where their families were well known and had lived for generations, and many could cross the line even when they looked different. Many Southern communities accepted individuals even when they knew those individuals were racially ambiguous—and that happened even while those communities supported slavery, segregation and very hard-line definitions of race.

So how did you find the three families you wrote about?

It was a long process. I began by trying to find as many of these families as I could in the historical record. That involved reading a lot of histories and memoirs, and then moving from there to dozens and dozens of court cases where courts had to determine whether people were black or white, and from there to property records and census records and draft records and newspaper accounts. And I developed a list of dozens, even hundreds of families that I could be writing about, and then narrowed it down. The three families that I chose represent the diversity of this process of crossing the color line and assimilating into white communities. I chose families that lived in different parts of the South that became white at different points in American history and from different social positions.

And how did those families come to know about their ancestry?

For many generations, members of these three families tried to forget that they had ever been African-American—and yet when I traced the families to the present and began contacting the descendants almost everyone I contacted knew about their history. It seems that the secrets of many generations are no match for the Internet. In many families, people would talk about going to the library and seeing that it had, say, a searchable 1850 census. One woman described the experience of typing in her great-grandfather’s name, finding him, and then having to call over the librarian to go through the handwritten enumeration form with her—she had to ask the librarian what “MUL” meant, not knowing it meant he was mulatto, or of mixed race. The Brooklyn Museum has acquired, by purchase from the London Gallery Robilant + Voena, Agostino Brunias’s (1730–96) painting Free Women of Color with Their Children and Servants in a Landscape (circa 1764–96), a portrait of the eighteenth-century mixed-race colonial elite of the island of Dominica in the West Indies. Brunias, a London-based Italian painter, left England at the height of his career to chronicle Dominica, then one of Britain’s newest colonies in the Lesser Antilles.

The painting depicts two richly dressed mixed-race women, one of whom was possibly the wife of the artist’s patron. They are shown accompanied by their mother and their children, along with eight African servants, as they walk on the grounds of a sugar plantation, one of the agricultural estates that were Dominica’s chief source of wealth. Brunias documented colonial women of color as privileged and prosperous. The two wealthy sisters are distinguished from their mother and servants by their fitted European dresses.

The painting is a Caribbean version of contemporaneous English works made popular by artists such as William Hogarth and Thomas Gainsborough, whose art often depicts the landed gentry engaged in leisurely pursuits. Free Women of Color with Their Children and Servants in a Landscape and other Caribbean paintings by Brunias celebrate the diversity of European, Caribbean, and African influences in the region.

Although Brunias was originally commissioned to promote upper-class plantation life, his works soon assumed a more subversive, political role throughout the Caribbean as endorsements of a free, anti-slavery society, exposing the artificialities of racial hierarchies in the West Indies. Among his supporters was Haiti’s liberator, François-Dominique Toussaint L’Ouverture, who wore on his waistcoat eighteen buttons decorated with reproductions of Brunias’s paintings.

Free Women of Color with Their Children and Servants in a Landscape will go on view on March 7, 2011, in the European galleries, on the portraiture wall between contemporaneous female Spanish colonial and French subjects.

Racial passing is one of America’s deeply hidden traditions, a largely unacknowledged and unstudied aspect of national life. Historically, African-Americans with identifiably dark skin have had only two choices when confronting racial discrimination and oppression: either they could try to ease their burden through accommodation, making the best of a bad situation, or they could engage in protest and active resistance. The situation was often quite different, however, for light-skinned African-Americans of mixed parentage. For them, there was a tempting third option of trying to pass as white.

The people who inhabit the pages of this book—New Orleans’s nineteenth-century Creoles of color—make difficult, yet fascinating, subjects of historical and cultural study. They are difficult for two reasons: (1) Their story, which is complicated and unfamiliar to most readers, requires Thompson to explain the precarious yet prosperous existence of a group of French-speaking free people of color, with ties to Europe and the Caribbean, in the midst of a U.S. slave society; (2) although most were well educated, and many of them were writers and intellectuals, few of their personal papers are stored in archives (most of those that have survived remain in private hands). Scholars, therefore, must look to a variety of sources to piece together the history of Creoles of color. In the book under review, this array of documentation includes legal and property records, Romantic poetry, newspaper editorials, and evidence of the built environment. To address such disparate sources, Thompson wields a number of methodological tools, from theories of urban space to literary criticism, historiography, and legal analysis.

LOS ANGELES — History repeats itself. But sometimes it needs a little polishing up from Hollywood.

Over the last few weeks, the writers of a pair of Civil War-era histories about the anti-Confederate inhabitants of Jones County, Miss., have been trading barbs in an unusual public spat. It began when the author of one book, rights to which had been sold to Universal Pictures and the filmmaker Gary Ross, discovered that Mr. Ross had spurred the publication of a new and somewhat sexier work on the same subject.

The encounter has created unexpected bad blood over incidents that occurred—or not—more than 100 years ago. And it offers a glimpse of the way that show business and its values have become entwined with the academic book world and its decision-making process.

On June 23 Doubleday published “The State of Jones: The Small Southern County That Seceded From the Confederacy,” a narrative history by the Harvard scholar John Stauffer and the Washington Post writer Sally Jenkins. The book, which on Monday was ranked No. 83 on Amazon’s best-seller list, presented Newton Knight, the leader of the renegade county, as a morally driven hero in the mold of John Brown—but whose appeal was enhanced by his romance with an ex-slave who, in the book’s account, became the love of his life as relations with his white wife cooled.

In the book’s acknowledgments, the authors thanked Mr. Ross, who they said had brought the idea to their editor, Phyllis Grann at Doubleday, and whose screenplay had served as “our impetus and our inspiration.”

This all came as a surprise to Victoria Bynum, a history professor at Texas State University, San Marcos. Her own book on the subject—“The Free State of Jones: Mississippi’s Longest Civil War”—had been published eight years earlier by the University of North Carolina Press, which sold the film rights to Universal as material for Mr. Ross’s project in 2007…
