The social construction of what are often called ‘racial’ categories has proceeded differently in different places. The bases of ascription and group identity, the placement of the boundaries between groups, and the power dynamics between groups have changed dramatically over time and social and political circumstance in each place. This article is a meditation and speculation on the ways that racial categories have been constructed and have changed in the United States and Britain over the course of the twentieth century.’ It uses the identity situations of people of multiple ancestries – Black and White, Asian and African and so on – as a tool to deconstruct the meanings assigned to racial categories and the power dynamics that underly those categories. The article lays out some things that the situation of multiracial people – people some of whose ancestors were Africans and some of whose ancestors came from somewhere else – tells us about the ways racial categories and meanings have evolved over the course of the twentieth century in the United States and in Britain. It finds, in sum, that White Americans have long had clearer ideas than White Britons about what they wanted to do with race; that those clear categories in the US are now breaking down, partly because of the rise of a multiracial consciousness on the part of some people of mixed parentage; and that a British innovation of the 1970s and the 1980s, a common Black identity for all non-White Britons, is no longer working very well, either.

Ada Copeland, an African-American woman born in Georgia just months before that state seceded from the Union, moved to New York City in the mid-1880s. There, she met a man named James Todd. He was light-skinned, handsome, had a good job for an African-American man in that time — a Pullman porter.

They hit it off, and eventually married. They had five children and a house in Brooklyn. Their story would be unremarkable if not for one detail: Nothing James had told his future wife was true.

“James Todd was really not black, he was not a Pullman porter, and he was not even James Todd,” author Martha Sandweiss tells NPR’s Steve Inskeep. “He was in fact Clarence King, a very well-educated white explorer who was truly a famous man in late 19th century America.”…

An intensely dramatic true story, Forsaking All Others recounts the fascinating case of an interracial couple who attempted—in defiance of society’s laws and conventions—to formalize their relationship in the post-Reconstruction South. It was an affair with tragic consequences, one that entangled the protagonists in a miscegenation trial and, ultimately, a desperate act of revenge.

From the mid-1870s to the early 1880s, Isaac Bankston was the proud sheriff of Desha County, Arkansas, a man so prominent and popular that he won five consecutive terms in office. Although he was married with two children, around 1881 he entered into a relationship with Missouri Bradford, an African American woman who bore his child. Some two years later, Missouri and Isaac absconded to Memphis, hoping to begin a new life there together. Although Tennessee lawmakers had made miscegenation a felony, Isaac’s dark complexion enabled the couple to apply successfully for a marriage license and take their vows. Word of the marriage quickly spread, however, and Missouri and Isaac were charged with unlawful cohabitation. An attorney from Desha County, James Coates, came to Memphis to act as special prosecutor in the case. Events then took a surprising turn as Isaac chose to deny his white heritage in order to escape conviction. Despite this victory in court, however, Isaac had been publicly disgraced, and his sense of honor propelled him into a violent confrontation with Coates, the man he considered most responsible for his downfall.

Charles F. Robinson uses Missouri and Isaac’s story to examine key aspects of post-Reconstruction society, from the rise of miscegenation laws and the particular burdens they placed on anyone who chose to circumvent them, to the southern codes of honor that governed both social and individual behavior, especially among white men. But most of all, the book offers a compelling personal narrative with important implications for our supposedly more tolerant times.

Images and interpretations of the past, present, and future of the American racial and ethnic landscape are contradictory. Many accounts focus on the increasing diversity that results from immigration and differential natural increase as well as the proliferation of racial and ethnic categories in census data. Less attention has been paid to the formation and erosion of racial and ethnic identities produced by intermarriage and ethnic blending. The framers and custodians of census racial classifications assume a “geographic origins” definition of race and ethnicity, but the de facto measures in censuses and social surveys rely on folk categories that vary over time and are influenced by administrative practices and sociopolitical movements. We illustrate these issues through an in-depth examination of the racial and ethnic reporting by whites, blacks, Asians, and Hispanics in the 2000 census. The emerging pattern, labeled here as the “Americanization” of racial and ethnic identities, and most evident for whites and blacks, is of simplified racial identities with little acknowledgment of complex ancestries. National origin is the predominant mode of reporting racial and ethnic identities among Asians and Hispanics, especially first-generation immigrants. The future of racial and ethnic identities is unknowable, but continued high levels of immigration, intermarriage, and social mobility are likely to blur contemporary divisions and boundaries.

America was a multiethnic and multicultural society from the outset. The original American colonies were formed during the seventeenth and eighteenth centuries as frontier societies composed of multiple founding populations (Klein 2004: Ch. 2). First among these were the indigenous peoples of North America, who were gradually displaced or absorbed by the more numerous European settlers and indentured servants from various parts of the world. Africans were imported primarily as slave labor from the Caribbean and West Africa, although some arrived as indentured servants on terms similar to whites. In the middle decades of the seventeenth century, some blacks became free settlers, but by the close of the seventeenth century, slavery and African heritage became nearly synonymous (Fredrickson 1981). With unbalanced sex ratios in frontier settings, large populations of mixed ancestry soon emerged, particularly in Southern colonies (Davis 1991). While some unions were the result of intermarriage or consensual liaisons, there was also widespread sexual exploitation of black women by white slave owners (Fredrickson 1981: Ch. 3).

The ethnic and racial landscape became even more complex during the nineteenth century. Continental expansion added lands that had been home to Native Americans and peoples of mixed indigenous and Spanish origin, and successive waves of immigration from Europe and Asia fueled the rapid growth of an increasingly diverse population. Tracking the mixed and un-mixed descendants from these many threads is a theoretical possibility, but not one that can be easily accomplished with historical or contemporary data. The problem is that the differential rates of settlement, natural increase, and intermarriage (or sexual unions) that produced progeny of mixed ancestry are largely unknown. Small differences in assumptions about the relative magnitudes of these processes can lead to greatly different estimates of the ancestral origins of the contemporary American population.

An even greater obstacle to describing the ethnic makeup of the American people is the assumption that most people are able and willing to accurately report the origins of their parents, grandparents, and more distant ancestors. In many cases, knowledge of ancestral origins is passed along in families or communities, but in some cases these narratives are suppressed or simply lost to history. As a result, the racial and ethnic composition recorded in censuses, surveys, and administrative records reflects a large degree of subjectivity and even speculation, in addition to actual patterns of genealogical descent. Methodological studies of census questions about race and ethnicity, for instance, show that responses are affected, often remarkably so, by the format of questions, the listed choices, and the examples included in questionnaire instructions (Farley 1991; Hirschman, Alba, and Farley 2000)…

Werner Sollors is the Henry B. and Anne M. Cabot Professor of English Literature and Professor of African and African American Studies at Harvard University. His major publications include “Beyond Ethnicity: Consent and Descent in American Literature and Culture;” “Neither Black Nor White Yet Both: Thematic Explorations of Interracial Literature;” and a book-length contribution on “Ethnic Modernism” in Sacvan Bercovitch’s “Cambridge History of American Literature.” With Greil Marcus he wrote “Ethnic Modernism and A New Literary History of America.”

Sollors is the recipient of a 1981 Guggenheim Fellowship and the Constance Rourke award for the best essay in American Quarterly in 1990. In 2000 he was elected Fellow of the American Academy of Arts and Sciences. He is also a corresponding member of the Austrian Academy of Sciences and of the Bayerische Amerika-Akademie. This paper explores geographies of diaspora for Anglo-Indians (formerly known as ‘Eurasians’) through a focus on their ‘homing desire’ in two diaspora spaces: firstly, an imperial diaspora in British India, and secondly, a decolonised diaspora in Britain after independence in 1947. Before independence, although Anglo-Indians were ‘country-born’ and domiciled in India, many imagined Britain as home and identified with British life in India even though they were largely excluded from it. Britain was often imagined as the fatherland, embodied by the memory of a British paternal ancestor, as enacted by settlement at an independent homeland for Anglo-Indians established at McCluskieganj in Bihar in 1933. By 1947, there were about 300,000 Anglo-Indians in India, but a third had migrated by the 1970s. I explore the implications not only of independence but also the British Nationality Act of 1948, which required many Anglo-Indians to prove the British origins of a paternal ancestor. The difficulties of tracing British ancestry are explored with reference to the work of the Society of Genealogists in London on behalf of Anglo-Indians in the subcontinent. Drawing on these records, as well as material from the Anglo-Indian press and interviews with women from one school who migrated after independence, I argue that ideas of Britain as home were intimately bound up with ideas of whiteness. Ideas about an Anglo-Indian diaspora existed long before decolonisation, and the migration of Anglo-Indians under the British Nationality Act led in many ways to a recolonisation of identity. Unlike studies that concentrate on ‘feminising the diaspora’, I argue that the diasporic ‘homing desire’ of Anglo-Indians invoked ideas of imperial masculinity in both imaginative and material terms.

Robert Stafford of Cumberland Island offers a rare glimpse into the life and times of a nineteenth-century planter on one of Georgia’s Sea Islands. Born poor, Robert Stafford (1790-1877) became the leading planter on his native Cumberland Island. Specializing in the highly valued long staple variety of cotton, he claimed among his assets more than 8,000 acres and 350 slaves.

Mary R. Bullard recounts Stafford’s life in the context of how events from the Federalist period to the Civil War to Reconstruction affected Sea Island planters. As she discusses Stafford’s associations with other planters, his business dealings (which included banking and railroad investments), and the day-to-day operation of his plantation, Bullard also imparts a wealth of information about cotton farming methods, plantation life and material culture, and the geography and natural history of Cumberland Island.

Stafford’s career was fairly typical for his time and place; his personal life was not. He never married, but fathered six children by Elizabeth Bernardey, a mulatto slave nurse. Bullard’s discussion of Stafford’s decision to move his family to Groton, Connecticut—and freedom—before the Civil War illuminates the complex interplay between southern notions of personal honor, the staunch independent-mindedness of Sea Island planters, and the practice and theory of racial separation.

In her afterword to the Brown Thrasher edition, Bullard presents recently uncovered information about a second extralegal family of Robert Stafford as well as additional information about Elizabeth Bernardey’s children and the trust funds Stafford provided for them.

Race Crossing

…Fleming’s use of the term ‘passing’ is also worthy of comment. Not only does it have the connotation of deceit and disguise, but it also implies that the offspring of mixed heritage could never be truly English, despite their birth in England and their English mothers. To cross racial boundaries (‘race crossing’) had two meanings: crossing the ‘colour line’ in terms of sexual relationships, and crossing races in the sense of being of mixed race. The white women who crossed the colour line and gave birth to mixed race children were not aliens as such, but liminally placed by virtue of their ‘unBritish’, ‘unpatriotic’ behaviour. Where the mothers were Irish, as some were (as Hodson noted) the mixed race children were even less likely to have been permitted the mantle of Englishness, for the Irish were not only ‘not English’, but frequently seen as ‘not white’ either. There was (and is) a hierarchy of whiteness, in which some people were/are white only some of the time, such as Irish, Latinos, and Jews. Fleming’s assumption that mixed race children were not, and implicitly could not, be English, sounds not dissimilar from the ‘one drop of black blood’ rule that was operating at this time in US Deep South. This ‘rule’ proclaimed that even a single black person in ones ancestry deemed one black. The system was a means of policing entry to the privileged category ‘white’. In the context of Britain in the interwar, the Eugenics Society was concerned with classifying and codifying those of mixed race in an attempt to reduce the threat to racial and national boundaries represented by their presence…

One of the longest unwritten chapters in the history of the United States is that of the relations of the Negroes and the Indians. The Indians were already here when the white men came and the Negroes brought in soon after to serve as a subject race found among the Indians one of their means of escape.1

There is no black Seminole…2

If you want to keep the bloodlines going, you got to keep’em separate…. the tribe is not trying to rewrite history-it’s just that the common fight for freedom that brought blacks and native people together 200 years ago doesn’t apply anymore.3

When we all started out, we started out as brothers. We fought together as brothers. Our blood ran together the same. When we settled we were still brothers. We were brothers until this money came up and then they went to pulling away.4

These sentiments and opposing points of view regarding the identity of Black Seminoles is at the heart of the matter in the case of Davis v. United States. The history of the Black Seminoles reaches as far back as the 17th century.  But the most recent history began in 1950 and 1951 when the Seminole Nation of Oklahoma (SNO) and Seminoles living in Florida filed claims for compensation for Florida lands ceded to the United States in 1823. In an attempt to quiet title to land taken from the Seminoles, in 1976 a $16 million judgment from the Indian Claims Commission (ICC) was awarded to the descendants of the “Seminole Nation as it existed in Florida on September 18, 1823.” The Department of Interior (DOI) directed that 75% of the money be distributed to the Oklahoma Seminoles, 25% to the Florida Tribes and nothing to the Freedmen or Black Seminoles because in 1823 they were considered slaves. Congress did not pass an act allowing distribution of the funds until 1990 which by this time, with interest, had ballooned to $56 million.

In 1996, Sylvia Davis, a member of the Dosar Barkus band of the Seminole Nation of Oklahoma, was denied a $125 school clothing allowance from the funds.  The Dosar Barkus and Bruner bands are Seminoles of African descent and are the only branches of the tribes being denied access to these funds. The Bureau of Indian Affairs (BIA) and the SNO argue that in denying their claims, they are not discriminating against the Dosar Barkus band based on race, but they are correctly enforcing the requirement that the funds be distributed to descendants as defined in 1823. The Black Seminoles, also known as Estelusi, were not considered members of the nation until 1866 when the U.S. government decided to recognize them as such after the passage of the Thirteenth Amendment, and passage of treaties imposed upon the Seminoles and a number of other Indian nations who owned slaves. These treaties provided for the emancipation of any slaves owned by the tribes and allowed them to incorporate the “freedmen” into the nation “on an equal footing with the original members”

Obviously, there is much more at stake in the Davis case than $125 worth of school clothes. What is at stake is how tribes, federal agencies and other entities, based upon both an historical analysis and today’s public policy concerns over the distribution of resources, will choose to define or identify as Indian or Black, numerous people who have over the years identified themselves as Black Seminole Indians either through blood quantum, social construct, cultural affiliation, or proven descendancy from an identified ancestor.

This article will not draw definitive conclusions about how to label or categorize an obviously mixed race of people. I will not endorse one position at the peril of alienating the legitimacy of the opposite stance. I only propose to point out the claims of both the Black and Red Seminoles.

Part II of the article explores the historical backdrop which created this ostensibly Black and Indian race. It also looks at the numerous definitions of the word “Seminole.” Part III looks at the Davis case, and the rich heritage of the plaintiff, Sylvia Davis. This section will not employ an in-depth analysis of the procedural, constitutional or other substantive legal issues that plain people will never understand to be the reason why they win or lose a case. Because to plain people that is not what the real issues are. The real issue to plain people is the end result of litigation, not procedural questions or issues which ultimately sends them away from the courts empty handed.

Part IV looks at the reaction and the community outcry after Davis as tribal leaders and disenfranchised Black Seminoles express their agreement or discontent over the outcome of the cases.

Part V briefly explores how DNA and genetic tests may or may not bolster the claims of Black Seminoles, followed by a conclusion which unfortunately gives no solid solutions but instead is merely a few concluding remarks and observations…
